[Chinese/English]外国人办理房产继承过户操作指南

当前国际经济交流日益增多,人口流动规模显增,但是境外人士继承国内的遗产却总是无从下手。笔者此前已经梳理过境外人士如何继承境内遗产的方式以及所需的材料,详见《境外人士继承境内房产难吗?指引奉上》。但是继承人获得法院裁判文书(包括调解书)或公证文书对继承的房产进行确权之后,如何到不动产交易中心过户?具体什么流程?需要什么材料?一次讲清楚!

With the increasing international economic exchanges, and growing population mobility, overseas individuals often find it challenging to navigate the inheritance process for domestic estates. The author has previously outlined the methods and required documents for foreigners to inherit domestic properties, as detailed in the "Is it Difficult for Overseas Individuals to Inherit Domestic Real Estate? A Guide Provided". However, after the heir obtains a court judgment (including a mediation agreement) or notarized documents to confirm the property rights of the inherited real estate, what is the process for transferring ownership at the real estate transaction center? What kind of documents are required? Let's clarify these details in one go!

办理继承过户的部门

Department responsible for handling inheritance and transfer procedures

依据《民法典》的规定,不动产的物权变动方式需进行登记。办理房产过户的部门为房屋所在地的不动产交易中心,(比如,房子位于静安区,则去静安区不动产交易中心,全称为静安区自然资源确权登记事务中心)。如需办理,应当在工作时间内前去办理,不动产交易中心的工作时间一般为周一至周五,受理时间:上午8:45-11:30,下午1:30-4:30

According to the provisions of the PRC Civil Code, changes in property rights for real estate require registration. The department responsible for property transfer is the real estate transaction center in the location where the property is situated. For example, if the house is located in Jing'an District, go to the Jing'an District Real Estate Transaction Center, also known as the Jing'an District Natural Resources Certification and Registration Affairs Center). To proceed, it is advisable to visit during working hours, typically Monday to Friday, with service hours from 8:45 AM to 11:30 AM and 1:30PM to 4:30 PM.

办理方式及所需材料

Processing method and required materials

外国人在办理继承过户时,可以分为以下三种情况:

NO.1    本人办理

Handling in person

继承人本人办理最为便捷,所需材料包括:1.本人的护照原件、复印件、翻译件、翻译件的复印件;2.产权人的身份证或者护照原件及复印件,护照翻译件及复印件(此项非必要);3.产证原件及复印件;4.确权文书原件及复印件(法院裁判文书或公证文书)。

Handling in person is the most convenient method. The required documents include:

(1) Passport original, copy, translated copy, and a copy of the translated copy;

(2) Property owner's ID card or passport original and copy, passport translated copy and its copy (not necessary);

(3) Property certificate original and copy;

(4) Original and copy of the property rights confirmation document (court judgment or notarized document).

NO.2    委托办理

Agency Processing

某些继承人长居国外,无法回国办理,所以选择委托国内的亲属或者律师进行办理,因此委托程序需进行公证。

1)委托人在当地公证(具体公证所需文件需要问当地公证机关),当前中国已经加入《关于取消外国公文认证要求的公约》(以下简称《海牙公约》),因此继承人所在国如为《海牙公约》缔约国,则公证文书将省去我国驻该国使领馆认证流程;

2)在国内公证处通过视频与委托人确认进行公证,费用大概六七千,具体以公证处收费为准。委托人除带好“本人办理”所需的第234项材料,还需带好委托手续的公证文书原件及复印件,国外的公证文书还需要有翻译件,以及被委托人的身份证。

Some heirs reside abroad and are unable to return to China to handle in person. Therefore, they choose to entrust relatives or lawyers domestic to handle it.  The delegate process requires notarization.

(1) The principal notarizes the documents locally (specific requirements should be confirmed with the local notary office). Currently, China has joined the Hague Convention. Therefore, if the country where the heir living in is a signatory to the Hague Convention, the notarized documents may skip the authentication process at the Chinese embassy or consulate in that country;

(2) Confirmation through video at a domestic notary office costing approximately 6000 to 7000 RMB. The specific fees is subject to the  charges of the notary office. In addition to bringing the materials required for Handling in person(items 2, 3, and 4), the principal should also bring the original and copy of the notarized document, translated copies for foreign notarized documents and the ID of the authorized person for the delegatioin procedure.

NO.3    法院出具强制执行文书

The court issues compulsory enforcement documents

向法院申请执行,并请法官出具强制执行文书,指定人员来办理,但是结合实践来看,法院并不一定会出具该类文书,因继承类案件法院在审理结束后对于涉案房屋已经进行确权,一般不需要其他人配合执行,所以很难出具强制执行,并且还要求法院指定其他人员代为办理,难度较大。此前曾去静安区不动产交易中心咨询,工作人员特地告知抬头要写两个,静安区税务局及静安区自然资源确权登记事务中心。

Applying to the court for execution, requesting the judge to issue a compulsory enforcement document and designate personnel to handle it. However, in practice, the court may not necessarily issue such a document. In inheritance cases, the court typically completes property confirmation after the trial, and cooperation from others is generally not required for execution. Therefore, it is chanllenging to obtain a compulsory enforcement, especially when the court demands the appointment of specific individuals to handle the matter. In a previous consultation at the Jingan District Real Estate Transaction Center, the staff specifically mentioned writing two headlings: including the Jing'an District Tax Bureau and the Jing'an District Natural Resources Certification and Registration Affairs Center.

办理流程

Handling Procedure

以上材料准备好以后,就可以到不动产交易中心进行办理。笔者近期陪同客户前往静安区不动产交易中心进行办理,所以就以静安区为例。办理过户,无需预约,因继承过户无需缴纳税款,但是还是要走一个完税流程。因此到了之后可以先去二楼取号,交完材料后大概半个小时,工作人员会出具一个完税证明,拿到之后到一楼引导台取号办理过户。各窗口提交材料或许有不同,但是不会超出上述材料范围,按照工作人员要求提交材料审核即可。

After the above documents are prepared, you can go to the Real Estate Transaction Center for processing. The author recently accompanied a client to the Jing'an District Real Estate Trading Center for processing, so take Jing'an District as an example. For property transfer, no appoinment is needed. Though there are no taxes involved inheritance transfer, you still need to go through a tax payment process. Hence, upon arrival, you can go to the second floor to take a number first. After submitting the documents, it takes about half an hour for the staff to issue a tax payment certificate. Once obtained, proceed to the guidance counter on the first floor to take a number for the transfer process. While different counters may have variations in document submission, they generally will not go beyond the requirements mentioned above. Follow the instructions from the staff to submit the documents for review.

取证时间及费用

Time & Cost

材料提交之后,制证登记需要缴纳80元,可以线上也可以现金,不过现金要到其他窗口缴纳。缴费之后工作人员会出具一个收据,制证时间大概需要一周,届时带着收据、本人的护照即可前来取新的产证。

After submitting the documents, there is an 80 yuan fee for certificate registration, which can be paid online or in cash. However, if paying in cash, you need to go to another counter to complete the payment. After payment, the staff will issue a receipt. The certificate production takes about a week. At that time, you can come with the receipt and your passport to get your new property certificate.
